SUBJECT:Notice of Public Workshop for Proposed Amendments to Rule 207 – Title V – Federal Operating Permit Program

The Staff of the Sacramento Metropolitan AQMD will conduct a public workshop to discuss proposed changes to Rule 207 – TITLE V – FEDERAL OPERATING PERMIT PROGRAM. Rule 207 contains procedures for an operating permit system consistent with the Title V requirements of the federal Clean Air Act. Title V permitting generally applies to major stationary sources of air pollution and other sources that are subject to specific federal rule requirements.

Staff is proposing amendments to Rule 207 to include greenhouse gas requirements. The amendments are necessary to comply with recent federal regulations. The key changes in the proposal are:

  1. incorporate greenhouse gas requirements into Rule 207; and
  2. subject new and existing stationary sources to Title V permitting based on their greenhouse gas emissions (this may require some existing sources not currently subject to Title V permitting to apply for a Title V permit).

Staff finds that the adoption of the proposed amendments is not subject to the California Environmental Quality Act because the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment. (Preliminary Review, Section 15060(c)(2) State CEQA Guidelines).
