SUBJECT: Proposed Rule 350 - Greenhouse Gas Program Fees

Staff is proposing the adoption of new Rule 350 – Greenhouse Gas Program Fees, which establishes fees to recover the District’s costs to implement the greenhouse gas emission reduction credit banking program established by Rule 250 – Sacramento Carbon Exchange Program, which was adopted on March 25, 2010. The District’s costs to implement the credit banking program include review and approval of emission reduction project plans, verification of greenhouse gas emission reductions, issuance of certified carbon credits, and maintenance of the District Bank.
Staff finds that the proposed Rule 350 is exempt from CEQA because CEQA does not apply to the establishment of fees by public agencies for the purpose of meeting operating expenses (Section 15273(a)(1), State CEQA Guidelines).
