Revised Notice of Public Hearing

Calendar

May 24, 2012

SUBJECT: Proposed Rule 250 – Sacramento Carbon Exchange Program and Proposed Rule 350 – Greenhouse Gas Program Fees.

Date New date: Thursday, March 25, 2010 (postponed from February 18)
Time 9:30 a.m.
Location Room 1450 (Board of Supervisors’ Chambers) County Administration Building 700 H Street Sacramento, California

The District Board will consider the adoption of two proposed rules: Rule 250 – Sacramento Carbon Exchange Program, And Rule 350 – Greenhouse Gas Program Fees.

Staff is revising this notice for the public hearing for proposed Rules 250 and 350 due to revisions in the proposed rules and staff report. Staff is proposing the adoption of Rule 250 to provide a mechanism for generating and banking carbon credits from voluntary greenhouse gas (GHG) emission reduction activities in Sacramento County.  To be eligible for this program, GHG emission reduction activities must follow approved protocols.  Proposed Rule 250 applies to anyone who wants to generate and bank carbon credits or wants to buy, sell, or use carbon credits registered in the District Bank.  Staff is also proposing the adoption of Rule 350, which establishes fees to recover the District’s cost to implement proposed Rule 250.

Staff finds that proposed Rule 250 is exempt from the California Environmental Quality Act (CEQA) because it can be seen with certainty that there is no possibility that it may have a significant effect on the environment (Section 15061(b)(3), State CEQA guidelines).  Staff also finds that proposed Rule 350 is exempt from CEQA because CEQA does not apply to the establishment of fees by public agencies for the purpose of meeting operating expenses (Section 15273(a)(1), State CEQA Guidelines).
