SUBJECT: Notice of Public Hearing for the Proposed Amendments to: Rule 801, New Source Performance Standards; and Rule 904, Air Toxics Control Measures

The Board of Directors of the Sacramento Metropolitan Air Quality Management District (District) will conduct a public hearing on March 27, 2008 at 9:30 A.M. in Room 1450 (Board of Supervisors’ Chambers), County Administration Building, 700 H Street, Sacramento, California. The purpose of the hearing is to consider the adoption of amendments to SMAQMD Rules 801 – NEW SOURCE PERFORMANCE STANDARDS, and 904 – AIR TOXICS CONTROL MEASURES.
Rule 801 adopts by reference federal regulations contained in Title 40 of the Code of Federal Regulations (CFR), Part 60, Standards of Performance for New Stationary Sources. The District Board will be considering amendments to Rule 801 to incorporate five new standards and to ensure that the most current version of each standard is adopted by reference.
Rule 904 adopts by reference the provisions of Title 17, Division 3, Chapter 1, Subchapter 7.5 of the California Code of Regulations. These statewide Airborne Toxic Control Measures (ATCMs) limit the emissions of toxic air contaminants from nonvehicular sources. The amendments to Rule 904 will include the most up-to-date version of the State’s ATCMs, including six new measures.
Staff finds that the proposed amendments to Rules 801 and 904 are exempt from the California Environmental Quality Act (CEQA) as ministerial actions under section 15268 of the state CEQA Guidelines.
